1. Definitions
For purposes of this agreement, the following terms apply:
"Company" means Lubeavto and its authorized representatives.
"Client" means any individual or legal entity requesting services through the website or directly.
"Website" means lubeavto.com.ua and all associated pages and services.
"Services" means vehicle search, selection, auction bidding assistance, purchase coordination, logistics, customs support, documentation guidance, and optional repair coordination.
"Vehicle" means any automobile offered for sale through auctions or private sellers in the USA, Georgia, Canada, or South Korea.
"Order" or "Request" means a formal client request for vehicle sourcing or import services submitted via form, email, or phone.
"Partners" means auction platforms, shipping companies, customs brokers, and other third-party service providers.
"Auctions" means Copart, IAAI, Manheim, and other recognized vehicle auction platforms.
"Fee" means the service charge paid to the Company for coordination and support services.
2. General terms
This agreement constitutes a public offer in accordance with applicable law. By submitting a request form, sending an email, calling the Company, or making a payment, the Client accepts all terms and conditions outlined herein.
The Company reserves the right to update this agreement at any time. Continued use of the website or services indicates acceptance of updated terms. Significant changes will be communicated via email or website notice.
This agreement is binding on both parties once the Client submits a formal request or makes an initial payment.
3. Services provided
The Company provides the following services:
• Vehicle search and selection based on Client specifications
• Market recommendations and pricing guidance
• Auction bidding assistance on Copart, IAAI, Manheim, and other platforms
• Purchase coordination and negotiation support
• Logistics and shipping arrangement
• Customs clearance support and documentation guidance
• Optional pre-purchase inspection coordination
• Optional repair coordination and oversight
• Regular communication and status updates throughout the process
The Company acts as a service provider and intermediary. The Company is not the seller of vehicles unless explicitly stated in writing. Final vehicle condition, availability, and sale terms depend on the original sellers, auction platforms, and market conditions. The Company does not guarantee specific vehicle availability or final sale prices.
4. Order and request procedure
Clients initiate the process by submitting a request form on the website, sending an email, or calling the Company directly. The Client must provide accurate information including budget range, desired vehicle make and model, year preference, and any specific requirements.
The Company will review the request and provide an initial response within one to two business days. The Company may request additional information or clarification before proceeding.
The Company reserves the right to decline any request if the specifications are unrealistic, incomplete, or outside the scope of available services. The Client will be notified of rejection with a brief explanation.
Once the Client confirms they wish to proceed, the Company begins the search and coordination process.
5. Pricing and payment terms
Service pricing depends on the scope of work, vehicle location, and destination country. The Company provides a detailed quote before work begins.
The service fee covers Company coordination, communication, and support. This fee does not include third-party costs, which are itemized separately:
• Vehicle purchase price (paid to auction or seller)
• Auction fees and buyer premiums
• Transportation and shipping costs
• Customs duties, taxes, and import fees
• Repair costs (if requested)
• Insurance and handling fees
Payment methods include bank transfer, credit card, and cryptocurrency (where applicable). The Client must pay the service fee before the Company begins work. Additional payments for third-party costs are due according to the agreed timeline.
All payments must be confirmed in writing. The Company provides invoices and payment receipts. Late payments may result in service suspension.
6. Client responsibilities
The Client agrees to provide accurate and complete information regarding budget, vehicle preferences, and contact details. Any changes to specifications must be communicated immediately.
The Client must confirm the final vehicle selection and purchase decision before the Company places a bid or initiates a purchase. Once confirmed, the Client is financially responsible for the transaction.
The Client must pay all fees and costs according to the agreed schedule. Failure to pay may result in service termination and potential legal action.
The Client acknowledges that used vehicles and auction vehicles carry inherent risks including hidden defects, mechanical issues, and prior damage. Photos and videos provided by auction platforms or sellers may not reveal all defects or condition issues. The Client accepts these risks and understands that the Company cannot guarantee vehicle condition.
7. Delivery timelines disclaimer
The Company provides estimated delivery timelines as non-binding guidance only. Actual delivery times depend on multiple factors outside the Company's control.
Common causes of delays include:
• Auction schedules and vehicle availability
• Shipping line schedules and port operations
• Customs processing and inspections
• Weather conditions and seasonal restrictions
• Mechanical inspections and repairs
• Force majeure events
The Company provides regular status updates and tracking information. The Client will be notified of any significant delays. The Company is not liable for delays caused by third parties or external circumstances.
8. Liability limitations
The Company is not responsible for:
• Hidden defects or mechanical issues not visible in auction listings
• Inaccuracies in auction platform descriptions or photos
• Changes in vehicle condition during transport or storage
• Delays caused by shipping, customs, or weather
• Exchange rate fluctuations affecting final costs
• Actions or negligence of third-party partners
• Loss of profits or indirect damages
The Company's total liability is limited to the service fee paid by the Client. The Client waives any claims for damages exceeding this amount.
The Company is not liable for Client decisions made based on auction listings, seller descriptions, or market conditions. The Client is responsible for their own due diligence and verification.
9. Refund policy
Refunds are available only in limited circumstances:
Non-refundable cases:
• Services already performed by the Company
• Auction bids placed or vehicles purchased
• Third-party fees paid to partners
• Shipping and logistics costs incurred
Partial refunds may be issued if the Client cancels before the Company begins work. Refund requests must be submitted in writing within seven days of payment.
All refunds are processed to the original payment method. Processing may take five to ten business days depending on the payment provider.
If a vehicle purchase is cancelled after bidding, the Client remains responsible for auction fees and any costs already incurred.
10. Vehicle condition and risks
Vehicles sold through auctions are typically sold "as-is" without warranties. The Company cannot guarantee vehicle condition, mechanical soundness, or title clarity.
Used vehicles commonly have wear, damage, or mechanical issues. Auction photos may not show all defects. The Client is responsible for understanding these risks before confirming a purchase.
The Company recommends optional pre-purchase inspections where available. Inspections are the Client's responsibility and cost.
The Client acknowledges full understanding of used vehicle risks and accepts the vehicle condition as presented by the auction or seller.
11. Privacy and data usage
The Company collects personal data including name, phone number, email address, and vehicle preferences. This data is used to provide services, communicate with the Client, and improve the website.
Data is protected according to applicable privacy laws. The Company does not sell or share Client data with third parties except as necessary to provide services (such as sharing information with shipping companies or customs brokers).
Data is retained for the duration of the service relationship and for a reasonable period afterward for record-keeping and legal compliance.
